GENERAL TERMS AND CONDITIONS

For the conclusion of bets with the company Top Goal Sports GmbH (hereinafter "TGS"), independent of the distribution channel, as well as the use of the website http://www.wetten.tv (Hereinafter referred to as the "Website"), please read the rules and these General Terms and Conditions (hereinafter referred to as "General Terms and Conditions"), which are binding. The recognition of the rules and the GTC is a compulsory condition for the conclusion of bets as well as the use of the Website. 1. PROVIDER

TGS is a company established under Austrian law and is located in Klagenfurter Str. 16 - 18, A-9500 Villach, Austria. It has been registered in the commercial register under the registration number FN 350572 y. TGS is entitled to the commercial conclusion of bets on the occasion of sporting events as well as to the mediation of such bets on the basis of an approval of the office of the Carinthian regional government. TGS pays betting and other taxes in Austria and is subject to the control of the office of the Carinthian provincial government. TGS offers the conclusion and mediation of bets for sporting events (hereinafter "sports betting") for its customers for which these terms and conditions apply.

2. APPLICATION OF THESE TERMS AND CONDITIONS

2.1 The General Terms and Conditions apply exclusively. They will apply to all bets accepted between the customer and TGS and include all existing business relationships, even if they are not expressly agreed again. This applies irrespective of the distribution channel and the various access options via the Internet (online) and the mobile telephone.

2.2 For each completed sports bet, the terms and conditions valid at the time of the acceptance of the sports bet by TGS apply. The customer is obliged to inform himself before the conclusion of a sports bet about the respective valid version of the GTC. TGS reserves the right to change the GTC at any time with immediate effect of all future bets from such change.

3. REGISTRATION / REGISTRATION (INTERNET ONLY)

3.1 The opening of a betting account is required for the use of the online offers. This is done via registration on the Website.

3.2 The registration is carried out using a user name and password to be selected by the customer (hereinafter referred to as "access data"). The access data may not be made accessible to a third party and must be kept strictly confidentially. TGS is not liable for the unauthorized use of a customer’s account or for the loss of the access data.

3.3 For registration with a user name, the customer must complete the registration form completely and truthfully.

3.4 Each customer may only register once with TGS. TGS reserves the right to verify the identity of the customer. For this purpose, the customer undertakes to send a photocopy of his photo ID (passport) as well as the credit card used on the website. If a customer is registered several times, all bets made by the customer can be cancelled and all accounts deleted. By registering and accepting these terms and conditions, the customer declares and warrants that:

He has reached the legal minimum age for participation in sports betting in their respective country and is fully capable of doing business;

In accordance with the relevant legal provisions, the conclusion of sports betting is not prohibited;

He is at liberty to dispose of the means by which he participates in bets, and such means are not gained from unlawful actions;

He acts exclusively on his own account;

He is entitled to use the credit cards and accounts associated with the account;

He does not use the betting account for illegal activities;

He is not aware of the outcome of the relevant sporting event in advance.

If the customer makes false statements against TGS, if he commits fraud or fraudulent attempts or violates these terms in any way, he can be excluded from the offer. This includes the cancellation of his registration and account.

3.5 Residents of the United States of America are prohibited from the use of the Website.

3.6 TGS is entitled to terminate the business relationship with customers at any time without stating reasons and / or to block the customer in whole or in part for the provision of sports betting.

4. COMPETITION (INTERNET ONLY)

4.1 General information

4.1.1 Registration automatically opens a betting account for the customer. The use of the contest by a third party is excluded insofar as the latter is not acting on the basis of a written authorization of the account holder, which is valid on the account of TGS, and he has proved his / her identity with the photocopy of his photocopy card.

4.1.2 The betting account is kept in the currency EURO (EUR). Payments and withdrawals as well as the conclusion of sports betting can only take place in euro.

4.2 Receipts

4.2.1 The deposit will be made by the payment provider listed on the website in the navigation menu under "Deposit". TGS reserves the right to add additional payment options or restrict or discontinue existing ones.

4.2.2 Each deposit must be at least Euro 10, - and may not exceed Euro 1,000. TGS reserves the right to charge transaction fees depending on the payment system used by the customer. The customer is explicitly informed about possible charges before the transaction on the website. The stated limits and fees apply only to the limits and fees of TGS.

4.2.3 A customer’s deposit will be credited to the betting account upon completion of the deposit process on the website. The credit is made after all the requirements have been met by the customer and the respective payment partner. Cancellation, withdrawal, etc. shall be excluded after the credit has been credited. Liability for a delayed credit is excluded, insofar as it is not based on intent or gross negligence of TGS.

4.2.4 Your credit card will be charged immediately after completion of the payment process with the text http://www.topgoal-sports.at or http://www.topgoalsports.at. We recommend to print a copy of the transaction data and keep it in a safe place.

4.3 Account Management

4.3.1 The betting account is free of charge.

4.3.2 The betting account is only run on a credit basis. Prior to participating in sports betting, the customer must make a deposit into the betting account. The acceptance of sports betting can only take place to the amount of the actual credit available. The granting of a loan and the transfer of the betting are excluded.

4.3.3 All deposits and withdrawals as well as bets and winnings made by the customer will be credited or debited to the betting account. Credits and debits are offset against each other and presented as a balance.

4.3.4 The customer may at any time dispose of existing balances on the betting account, taking account of bets already concluded but not yet evaluated. The credit can be used for the conclusion of further bets or be paid out to the customer.

4.3.5 An existing credit on the betting account is not interest-bearing.

4.3.6 If an existing betting account has been idle for more than 18 months, TGS has the right to close this account and dissolve it. Any existing credit will be transferred to the customer's last TGS account if this credit is higher than any charges associated with the payment. In any case, the customer will be informed by TGS of the latest known contact data. If the credit cannot be paid out, as the customer cannot be reached under the reported data, the payment claims expire within the legal time limits.

4.4 Corrections / Approval

4.4.1 TGS is entitled to correct any obvious errors on the betting account at any time. The customer shall be informed immediately of any corrections made.

4.4.2 All account movements as well as the current balance can be viewed on the website in the navigation menu under "Account statement". The customer is obligated to regularly check the movements of the accounts on a regular basis and to inform TGS immediately of any cancellations. Objections to individual account movements and / or the current balance must be submitted by e-mail to TGS (support@wetten.tv) within 14 days of setting it up on the website. Otherwise, the individual account movements and the respective balance are recognized.

4.5 Pay-out

4.5.1 The customer can have an existing credit balances on his betting account, taking into account bets already completed, but not yet evaluated bets, in the navigation menu under "Withdraw funds". The payment procedure must be completed on the website.

4.5.2 The payment will be made by the payment provider listed on the website in the navigation menu under "Withdraw funds". TGS reserves the right to add further payment options or to restrict or discontinue existing ones.

4.5.3 A prerequisite for a first payment is for the customer to send a credit note by letter to verify the customer’s identity, home address and personal data via the sharing of for example a utility bill dated within the last 3 months.

4.5.4 Payments shall only be made in favor of the customer registered with TGS. A disbursement to third parties or a division between betting groups is excluded.

4.5.5 All withdrawals must be made by the same payment method used for deposits. TGS is entitled, in individual cases, to make payment by alternative means and use the customer data known for this purpose. The customer is obliged to notify TGS immediately if his data has changed.

4.5.6 The customer undertakes not to make any back-up charges or to reverse any payments made (chargeback). All costs and damages resulting from such behavior shall be borne by the customer.

4.5.7 TGS reserves the right to block an account if credit card fraud is suspected; In particular, the use of stolen credit cards or other fraudulent actions. The Company has the right to undo any pay-out on a credit card and recover all profits on your account. The company is not liable for the misuse of credit cards.

4.5.8 The customer is fully liable for the settlement of the account balance on a betting account. If an account is incorrectly credited or debited, the customer shall immediately notify TGS. All amounts wrongly credited to an account are to be repaid immediately. All amounts that were incorrectly debited from an account are also to be repaid. Money which is wrongly credited to an account may not be used by the customer for betting purposes. TGS reserves the right to declare all transactions paid out of such account balances invalid. The parties agree to indemnify the other party in respect of any wrongly credited or debited amounts of money.

4.5.9 Each pay-out must be at least Euro 30, - (plus any fees), unless it is an account resolution. TGS reserves the right to charge transaction fees depending on the payment system used. The customer is explicitly informed about possible charges before the transaction on the website. The stated limits and fees apply only to the limits and fees of TGS. The respective providers and payment partners can set different limits and charge additional fees.

4.5.10 Upon completion of the payment process and the necessary examination of the requested payment, the payment order will normally be issued within 24 hours or on the following bank day, in normal working hours from Monday to Friday.

4.5.11 bonuses and advertising campaigns

Any bonuses will not apply to a cashout. Bets settled by cashout will not be considered for satisfying bonuses. Free bets can not be settled via cashout.
TGS reserves the right to discontinue, remove or change the Cashout feature at any time. TGS alone decides to offer the cashout for certain events or markets.
TGS reserves the right to accept or reject betting applications for markets, events, competitions, etc., for which the Cashout feature is relevant.
TGS also reserves the right to annul a cashout if it has been accepted after the result of the event, the market or the bet has already been determined, or to cause a chargeback if the market or event is incorrectly cleared ,
TGS is not liable if the cashout is unavailable for technical or other reasons. In such cases the bets will be settled according to the actual result.

5. CONCLUSION OF SPORTS BETS

5.1 Conclusion of contract

5.1.1 Sports betting on the Internet is concluded between TGS and the respective customer registered with his / her user name and password on the website.

5.1.2 Every sports bet, independent of the distribution channel, is accepted, held and concluded exclusively in Austria.

5.1.3 When placing a bet on the Internet, the corresponding amount is debited from the customer’s account. When the bet is placed in a mediation agency, the bet is to be paid immediately after the bet has been placed; Otherwise the bet will be cancelled by TGS.

5.1.4 The customer, irrespective of the distribution channel, is obligated to check the completed ticket before submitting the bet. After the bet is submitted, neither a cancellation nor a change of the bet is possible. The company is free to refuse a bet without giving any reason or to accept only a part of a bet.

5.1.5 If a customer places several bets, they are processed in the order in which they are received on the central computer of TGS.

5.1.6 Multiple bets can be considered a bet when one customer places the same bet. TGS reserves the right to declare bets invalid if there is evidence that there is a secret agreement between two or more customers.

5.1.7 The acceptance and payment of bets is limited by different limits. These include, in particular, limit values, limits on bets, maximum pay-out limits and personal customer limits. These limits are generally permissible and will be displayed on the betting slip or in the account. TGS reserves the right to limit the bets before a bet is accepted or to change the odds before a bet is placed. In particular, the acceptance may be refused if the customer or the betting offer violates these terms and conditions or the betting provisions.

5.1.8 All quotas are generally permissive. All bets accepted after the official start will be void.

5.1.9 A bet is deemed to be accepted if the acceptance has been confirmed and a bet number has been given. If the bet has been placed the bet is then visible under "My open bets" and “Betting History”.

5.1.10 When placing the bet, the customer confirms that he has read and understood the rules on betting and sports, as well as the course and risks of betting, betting and online betting in general.

5.1.11 TGS shall not be liable (irrespective of the cause) of the fact that a bet cannot be placed, including, in particular under the circumstances of computer failures or malfunctions, disruption of telecommunications services or Internet connections. The transfer of a bet is not sufficient for the placement of a bet - the bet is basically started when the verification code has been sent and the bet is displayed under the heading "My open bets" and “Betting History” or a confirmed betting slip has been issued.

5.2 Minimum use, limits and fees

5.2.1 The minimum bet for each bet is Euro 1.00.

5.2.2 The minimum use for a system tip is Euro 0.05.

5.2.4 TGS can determine different limits in the individual case on the website, in the mediation agency or the issued bet slip.

5.2.5 The customer is not entitled to a credit of profits exceeding the stated pay-out limits. The amount exceeding a pay-out limit is forfeited. Liability for loss of profit is excluded.

5.2.6 A fee of 10% of the bet amount for single bets and 5% for double bets will be awarded for the conclusion of sports betting. No fee will be charged from a three-player bet. TGS is entitled to change these fees at any time.

5.3 Other agreements, declarations and prohibitions

5.3.1 The customer acknowledges the GTC by submitting a betting offer.

5.3.2 The customer declares that at the time of his bid on the conclusion of a sports bet the outcome of this event is unknown to him and that no agreements or other manipulations of the outcome are known to him.

5.3.3 The customer declares that he is acting in his own name and for his own account and the conclusion of sports betting is not prohibited by law.

5.3.4 If, following the acceptance of the sports betting by TGS, the evaluation of the relevant event cannot be carried out unequivocally, TGS is entitled to declare the bet invalid.

5.3.5 The submission of so-called "organized betting" is prohibited. Every customer can not directly and indirectly - even together with other customers - bet on the same event. Otherwise, TGS is entitled to declare the bets invalid even after the evaluation has been carried out.

5.3.6 TGS employees are excluded from participation in sports betting. The submission of offers for sports betting on behalf of bookmakers or betting agents is prohibited.

5.3.7 A customer is prohibited from wagering on an event in which he himself is involved in the widest sense, whether as a participant, referee, consultant, coach, supervisor, owner, etc., or on behalf of a participant.

5.3.8 Sports bets submitted or accepted after the start of the event shall be invalid for any reason whatsoever, in particular in the event of technical difficulties or in the event of a forwarding of the event. They are also invalid if, until the beginning of the event, information becomes known through which the outcome can be determined.

5.3.9 In the case of a breach of a provision of section 5.3 of these General Terms and Conditions, the sports betting concerned may be declared invalid.

5.4 Evaluation

5.4.1 The results shall be published by the jury (official sports federations) on the same day until 24.00 hrs (local time at the venue) after the event has ended. Any subsequent change in the result / classification, e.g. By sports courts etc. has no influence on the evaluation of the sports betting. Liability for incorrect publications is excluded.

5.4.2 Unless otherwise stated on the website, the result of the regular season is decisive (without extension, etc.).

5.4.3 The profit is determined by multiplying the stake by the profit ratio. It is credited to the betting account.

5.4.4 Cancellation, interruption, transfer, non-participation, assignment, cancellation, misjudgement, contestation, etc. shall be governed by the Terms and Conditions and other regulations.

5.4.5 TGS reserves the right to correct obvious errors (incorrect results, matchmaking, odds, account movements, calculations, etc.) at any time or to declare the bets invalid. Liability for damage caused by such defects is excluded.

5.4.6 If there is a suspicion that the outcome of the event has been impacted unlawfully or unfairly, TGS is entitled to refuse the evaluation, crediting and payment of winnings in full.

5.5 Invalid bets / complaints

5.5.1 If an invalid bet is present or the bet is declared null and void, the bet is valued at a rate of 1.00. In the case of a single bet, the customer is credited with the bet made for this bet to his betting account. In the case of a combination bet, the invalid or void bet is won with the odds of 1.00, so that the overall quota of the combination bet is determined without the odds attributable to the invalid / void bet. In this case, a credit note is not credited.

5.5.2 The customer is obliged to check the evaluation of personalized sports bets immediately under "Betting history" in the navigation menu and errors within two weeks at info@wetten.tv. Complaints that are received later than two weeks after the evaluation of the sports betting on the website at TGS cannot be considered. The evaluation is deemed to be recognized if the message has not been reported correctly.

5.5.3 The customer is obligated to notify TGS without delay of incorrect bookings and incorrect evaluations in his favor and not to dispose of the unauthorized credit.

6. DATA PROCESSING

6.1 TGS collects data from the customer within the scope of the business relationship. TGS observes the provisions of the Federal Data Protection Act. Without the customer's consent, the customer's TGS data will only be collected, processed or used to the extent that this is necessary for the processing of the legal relationships, in particular the conclusion of sports betting, the verification of the corresponding authorization and the execution and booking of deposits and withdrawals on the betting account. In the course of the business relations, TGS is entitled to pass on data - if necessary - to a third party.

6.2 Without the client's consent, TGS will not use the customer's data for purposes of advertising, market or opinion research. They are not passed on to third parties, subject to clause 6.1, unless TGS is legally obliged to make a disclosure.

6.3 In all other respects, the data protection declaration, which can be downloaded from the website in printable form at the end of the GTC, is referred to in relation to the customer's consent and further information on data collection, its processing and use.

6.4 If the suspicion of game manipulation or betting is suspected, TGS is entitled to forward the stored data to bodies responsible for clearing up and prosecuting such offenses, in particular authorities and sporting associations.

7. ERROR CORRECTION / DISCLAIMER / DISCLAIMER

7.1 TGS reserves the right to correct obvious errors (incorrect results, matchmaking, odds, account movements, calculations, etc.) at any time or to declare the bets invalid. Liability for damage caused by such defects is excluded.

7.2 Claims of the customer for damages are excluded. This excludes any claims for damages on the part of the customer resulting from injury to life, body, health or from the violation of essential contractual obligations (cardinal obligations) as well as liability for other damages arising from an intentional or grossly negligent breach of duty by TGS, its legal representatives or vicarious agents. Significant contractual obligations are those whose fulfilment is necessary to achieve the objective of the contract.

7.3 In the case of violation of essential contractual obligations, TGS is only liable for the foreseeable damage which is typical for the contract, if this is simply caused by negligence, unless the customer is claiming damages from injury to life, body or health.

7.4 The limitations of clauses 7.2 and 7.3 shall also apply in favor of TGS 'legal representatives and vicarious agents if claims are directly asserted against them.

7.5 The customer may only offset against TGS claims if the claims of the customer have been legally established or expressly acknowledged.

8. APPLICABLE LAW / COURT OF JUSTICE

8.1 The legal relationships between TGS and the customer are subject to Austrian law, to the extent permitted by law, to the exclusion of the references to international private law. The place of performance and fulfilment of all obligations between TGS and the customer is the seat of TGS.

8.2 Austria shall be the court of jurisdiction for all disputes between TGS and the Customer, as permitted by law.

9. SUPPLEMENTARY TERMS FOR THE TOPGOAL-Sports GmbH- CUSTOMER CARD

9.1 The customer card can be requested at any participating agency. There is no legal right to issue a customer card. The issue of a customer card can be denied by TGS or the agency without giving reasons.

9.2 The card issuing agency is solely responsible for the credit on the customer card. Payments and withdrawals can only be made there. TGS accepts no liability for the credit of the customer card.

9.3 The customer is obligated to regularly check his betting account led by the customer card. In case of irregularities, the customer must notify the issuing agency immediately.

9.4 The customer card is registered to its owner and is not transferable. The card remains the property of TGS. For the purpose of checking or avoiding the misuse of the card, the user must identify the customer card at the request of the agent's agent or TGS upon presentation of the customer card.

9.5 The customer card must be kept with special care in order to prevent it from being lost and misused. The loss of the card must be reported immediately to the card issuing mediation agency, which causes a blocking of the customer card at TGS. Liability of TGS for abusive use of the card is excluded.

9.6 The customer is responsible for keeping his password secret. TGS accepts no liability for bets made by third parties to whom such data is known.

9.7 If the customer card is lost, the user can apply for the issuance of a new card and the transfer of the credit card to this new card upon presentation of suitable ID documents. TGS reserves the right to charge a reasonable cost and expense.

9.8 The cancellation shall be effected by collecting or blocking the customer card. In this case, a reimbursement of the residual credit including possible bonuses or parts thereof is excluded. TGS reserves the right to prosecute any misuse of the customer card.

9.9 TGS reserves the right to change, terminate, or replace the service offer of the Customer Card at any time, subject to a reasonable period and with due regard to the user's interests. The user is informed about this by means of a notice in the mediation agency. In the event of an important reason (e.g. changes to the law), the hiring, supplementation and / or modification of the service offer or parts of it may be permitted without observing a deadline.

9.10 The liability of TGS GmbH. For damages of the user, which arise at or from the use of the customer card is excluded. For all disputes arising from or in connection with the use of the customer card, the place of the card issuing agency shall be agreed as the place of jurisdiction.

9.11 All winnings from bets placed on the customer's card are automatically credited to this card. Printouts of the stored bets serve merely for the information of the user and do not constitute any payment claim. Payments of credit stored on the customer card are possible against the signing of a payment deposit in the card issuing switching agency or a switching agency authorized by it. For the purpose of the control or the avoidance of misuse, the presentation of suitable identification documents may be required.

9.12 All customer credits are managed exclusively by the issuing agency. There is no entitlement to a pay-out by TGS.

10. GAME CONDITIONS AND OTHER COMPETITIONS

10.1 There are special rules and regulations for certain sports and betting markets. The customer must first observe the specific rules of the sports. These specific rules take precedence over the General Rules. The general rules and regulations apply to the non-listed sports.

10.2 The following rules apply to the evaluation of the betting exit:

10.2.1 The results reported after the end of the event are decisive.

10.2.2 In the case of football matches, the result is determined within normal, without extra time (without penalty), without Golden Goal (with the exception of special prizes offered).

10.2.3 For ice hockey games, the result is the regular time of the game, without extra time (extra or overtime) and without penalties (except special offers, which are indicated).

10.2.4 In the case of basketball matches, the result is generally decisive, taking into account any eventual extension. In the case of specially marked events, an event may be deemed to be undecided after the regular playing time has elapsed. In this case, prior notice is given to the event and a third (X) quote is offered.

10.2.5 In the case of baseball games, the result is decisive taking into account possible "extra innings".

10.2.6 In any case, the winner of an event shall be deemed to be the winner by the jury (the official sports association) on the day of the event until 24:00 (local time at the venue). This also applies to long-term betting. Any changes to the result / classification, for whatever reason, after this date, have no effect on the profit distribution.

10.2.7 If there is no winner on the basis of the "point-spreads" (for example, if a team wins -5 points with 5 points), the bet is scored with odds of 1.00.

10.2.8 If the event takes place in accordance with the present conditions and if a participant or a team does not attend the event, the betting contract remains valid ("playorpay"); This means that a bet made to a non-participant or to a non-participant team is considered lost for the customer.

10.3 In the following cases, the bet is void or the betting contract is subsequently resolved as amicable, with the result that the bet must be repaid to the customer:

10.3.1 The betting only takes place after the actual start of one or several events.

10.3.2 If the event does not occur as specified in the program. This also applies to events which are mistakenly listed incorrectly in the betting program (exchanged place bets), but not in the case of a possible renouncement of the right of home, in the case of a suspension of the place of the marathon, or in the event of the event in a neutral place.

10.3.3 If the event does not take place according to the regulations.

10.3.4 If an event is cancelled or does not take place and has not started again until the end of the next calendar day.

10.3.5 If an event without an official rating is terminated and has not started again until the end of the next calendar day. Exceptions are football and ice hockey games, which are cancelled after the regular season.

10.3.6 If a tennis match is cancelled for reasons of injury or illness of a participant, the bets are considered cancelled and are counted with the odds 1.00. Bets on interrupted tennis matches (permitting) remain valid, provided that the game is played during the course of the tournament. If a tennis match is decided by task or disqualification, this event is calculated with the odds 1.0.

10.3.7 Bets on baseball games are considered cancelled and will be considered with the odds of 1.00 if the game does not take place on the day of the original betting and is not made up within 12 hours after the original start time.

10.4.5 Betting on baseball - "total runs" and baseball handicaps are considered official when at least 9 innings are played or 8 1/2 innings when the home team leads. Otherwise, such bets will be deemed cancelled. The result after the last, full inning is always decisive, unless the home team balances or takes the lead in the second half of an inning. In this case, the result counts immediately at the time of the break.

10.5 For combinations and single bets:

10.5.1 If one or more events are cancelled, or do not take place for other reasons, the event (s) will be valued at a rate of 1.00. If all events are cancelled, cancelled (without valuation), or for some reason do not take place, the betting contract is cancelled and the bets are repaid. This also applies to events which are mistakenly listed incorrectly in the betting program (exchanged place bets), but not in the case of a possible renouncement of the right of home, in the case of a suspension of the place of the marathon, or in the event of the event in a neutral place.

10.5.5 In principle, the ad hoc decisions of the arbitrator or the jury always apply at the time of the event taking place or at the end of the event. All subsequent decisions "at the green table" or through other statutes and procedures have no influence on the evaluation of the event. If more than one winner (dead race) in an event, the respective hit rates are divided accordingly by the number of winners of the betting event.

11. SUPPLEMENTAL COMPETITIONS LIVE BETTING (TopGoal-Sports GmbH)

11.1 The customer card can be requested at any participating agency. There is no legal right to issue a customer card. The issue of a customer card can be denied by TGS or the agency without giving reasons.

11.2 The card issuing agency is solely responsible for the credit on the customer card. Payments and withdrawals can only be made there. TGS accepts no liability for the credit of the customer card.

11.3 The customer is obligated to regularly check his betting account led by the customer card. In case of irregularities, the customer must notify the issuing agency immediately.

11.4 The customer card is registered to its owner and is not transferable. The card remains the property of TGS. For the purpose of checking or avoiding the misuse of the card, the user must identify the customer card at the request of the agent's agent or TGS upon presentation of the customer card.

11.5 The customer card must be kept with special care in order to prevent it from being lost and misused. The loss of the card must be reported immediately to the card issuing mediation agency, which causes a blocking of the customer card at TGS. Liability of TGS for abusive use of the card is excluded.

11.6 The customer is responsible for keeping his password secret. TGS accepts no liability for bets made by third parties to whom such data is known.

11.7 If the customer card is lost, the user can apply for the issuance of a new card and the transfer of the credit to this new card upon presentation of suitable ID documents. TGS reserves the right to charge a reasonable cost and expense.

11.8 The cancellation shall be effected by collecting or blocking the customer card. In this case, a reimbursement of the residual credit including possible bonuses or parts thereof is excluded. TGS reserves the right to prosecute any misuse of the customer card.

11.9 TGS reserves the right to change, terminate, or replace the service offer of the Customer Card at any time, subject to a reasonable period and with due regard to the user's interests. The user is informed about this by means of a notice in the mediation agency. In the event of an important reason (e.g. changes to the law), the hiring, supplementation and / or modification of the service offer or parts of it may be permitted without observing a deadline.

11.10 The liability of TGS GmbH. For damages of the user, which arise at or from the use of the customer card is excluded. For all disputes arising from or in connection with the use of the customer card, the place of the card issuing agency shall be agreed as the place of jurisdiction.

11.11 All winnings from bets placed on the customer's card are automatically credited to this card. Printouts of the stored bets serve merely for the information of the user and do not constitute any payment claim. Payments of credit stored on the customer card are possible against the signing of a payment deposit in the card issuing switching agency or a switching agency authorized by it. 11.12 All customer credits are managed exclusively by the issuing agency. There is no entitlement to a pay-out by TGS.

12. GAME CONDITIONS AND OTHER COMPETITIONS

12.1 There are special rules and regulations for certain sports and betting markets. The customer must first observe the specific rules of the sports. These specific rules take precedence over the General Rules. The general rules and regulations apply to the non-listed sports.

12.2 The following rules apply to the evaluation of the betting result:

12.2.1 The results reported after the end of the event are decisive.

In this case, prior notice is given to the event and a third (X) quote is offered.

12.2.5 In the case of baseball games, the result is decisive taking into account possible "extra innings".

12.2.6 In any case, the winner of an event shall be deemed to be the winner by the jury (the official sports association) on the day of the event until 24:00 (local time at the venue). This also applies to long-term betting. Any changes to the result / classification, for whatever reason, after this date, have no effect on the profit distribution.

12.2.7 If there is no winner on the basis of the "point-spreads" (for example, if a team wins -5 points with 5 points), the bet is scored with odds of 1.00.

12.2.8 If the event takes place in accordance with the present conditions and if a participant or a team does not attend the event, the betting contract remains valid ("playorpay"); This means that a bet made to a non-participant or to a non-participant team is considered lost for the customer.

12.3 In the following cases, the bet is void or the betting contract is subsequently resolved as amicable, with the result that the bet must be repaid to the customer:

12.3.1 The betting only takes place after the actual start of one or several events.

12.3.2 If the event does not occur as specified in the program. 12.3.7 Bets on baseball games are considered cancelled and will be considered with the odds of 1.00 if the game does not take place on the day of the original betting and is not made up within 12 hours after the original start time.

13. SUPPLEMENTAL COMPETITIONS LIVE-BETTING (TopGoal-Sports GmbH)

13.1 The following points apply in addition to the general bets for the offered live bets.

13.2 Live bets are also offered during an event to the existing sports betting program. The odds are updated according to the game.

13.3 If a (play) and / or time display is displayed during a live bet, this serves only for orientation regarding the approximate game progress. For technical reasons, this display does not always correspond to the exact official start or play time. Decisive is always the actual state of betting.

13.4 If a live bet is void according to these bets for live bets, it will be valued and repaid with a replacement rate of 1.00.

13.5 Any live bet received after the outcome of the bet is invalid. The actual point in time of the event, irrespective of any advertisements or betting receipts, is always decisive.

13.6 TGS may offer the repurchase of a live bet. The repurchase value is variable. TGS is not required to buy a live bet back.

13.7 Accepted bets: Valid bets, which have been completed and accepted in time - apart from the cases mentioned in these terms for live bets - cannot be cancelled or changed. The customer has to convince himself before betting of the correctness of his bet (odds, bet, etc.). It is therefore the sole responsibility of the customer to ensure that all the details of his bet are correct.

13.8 Error: No liability is assumed for input, transmission and / or evaluation errors. In particular, TGS reserves the right to correct obvious errors in the entry of bets, results and / or the evaluation of results (e.g. confusion of odds, teams, events) subsequently and to declare the bets concerned invalid. Only the amount stored in the system is valid as a bet.

13.9 Determined bets: All live bets, which are actually decided and correctly valued (i.e. the result is already fixed), are valid and will be evaluated at any time, regardless of the eventual aborting of the event / tournament (note the point "Error").

13.10 Results: Live bets are valued according to the results, which are known immediately after the decision of the bet. Subsequent changes (e.g., results judged by a jury after the game) do not affect the evaluation of the offered live bet. All results are taken from the official statistics of the respective leagues and are also based on TV recordings of live games. If the insights of TGS from the TV recordings deviate from the official statistics, live bets will be evaluated according to the own statistics of TGS, which are based on the actual course of the game. Unless otherwise stated, all bets on "non-participants" are void on live bets. If a winning, total score or handicap bet is drawn and no odds have been offered for these options, all bets will be void.

13.11 Rules: In the case of live bets, separate rules (see point 11 below) will be used in the event of a play-off. Exceptions are the bets, which are decided before the actual interruption. These are validated.

13.12 Game Interruption: If a game is offered for which a live bet is offered, but continues to an event up to and including 24:00 local time the next day at the original venue, all not yet decided bets remain valid for this game. If, however, the game is cancelled or an interrupted game is not played within the above deadline, all live bets that are not yet decided will be void.

14. SPECIAL REGULATIONS (TopGoal-Sports GmbH)

14.1 In addition to the foregoing general rules for live betting, the following special rules apply to individual sports / betting markets.

14.5 Special rules Volleyball - The betting markets refer, unless otherwise stated, to the regularly required number of sets. Live bets on winnings: This wager refers to the winner of a given set. The set must be terminated regularly so that the bets remain valid.

14.6 Special rules Basketball - All betting markets include a possible extension. Live bets on the outcome of a game section are valid when the game is terminated regularly. It only counts the result of the relevant game section.

15. OTHER CONDITIONS

15.1 The participant is not obliged to participate in gaming events. Participation in game events takes place at their own request and at the participant's own risk. (In electronic or any other form) shall be automatically invalid if they are corrupted, mutilated, falsified, manipulated or otherwise altered in any manner, are illegible, mechanically or electronically reproduced, are not acquired by law or are subject to printing, production or typographical, Mechanical, electronic or other errors. All playing cards and other materials received by the operator for the purpose of proof of a profit claim shall be the property of the user and shall not be returned. Liability for lost, late-filed, illegible, incomplete, damaged, mutilated, incorrectly addressed or insufficiently franked inquiries, profit claims or documents by the operator is excluded. Liability for defective play materials for participation in gaming events is limited to their replacement. Taxes and duties on game winnings are the sole responsibility of the participant. If a participant does not dial into his account with his subscriber data (user name and password) over a period of 120 days, his credit can be withdrawn after prior notification to the deposited e-mail address and the account can be deleted. If the affected participant dies, his immediate survivors are sought and the credit is paid to them.
